Synop, Inc. (“we”, “us”, or “our”) operates the https://synop.ai website and any other website that links to this Privacy Policy (each, a “Site” and collectively, the “Site”).  This Privacy Policy (this “Policy”) applies to the Site and to any mobile application (“App”) offered by us that references or links to this Policy (collectively, the “Services”).

This Policy applies to information collected via the Services.  This Policy describes what personal information is collected via the Site or App, how it is used and with whom it may be shared and what choices are available to you regarding the use of your personal information.  When we use the term “personal information” we mean information that can be used to identify a particular individual (directly or indirectly).

Information Collection 

Information You Provide

We have access to and collect information that you voluntarily give us via the Services.  While using the Services, you may choose to complete one of our webforms and provide us with certain personal information that can be used to contact or identify you.  Personal information we may collect, should you choose to provide it to us, includes your email address, phone number, and company name.   

Certain registered users of our Services may have the opportunity to make payments in connection with the Services. We do not process such payments ourselves or collect payment card or bank account information; any such financial account data is provided by the user directly to our third party payment processor, Stripe, and not to us. Information We Collect Automatically

We may collect certain personal information when you visit or interact with the Services.  For instance, like many website or app operators, we may use “cookies” and similar technologies. Information From Other Sources

Certain information may be provided to us from other sources, such as vehicle data and charging infrastructure data, depending on how you use the Services.  We may receive vehicle data transmitted from a telematics device installed onboard a vehicle that is connected to the Services.  Vehicle data may include vehicle location, speed, acceleration, braking, trip distance and time, engine idling, and vehicle health.  Charging infrastructure data may include location, charge time, charging ports and power, utilization, model, and pricing.  Generally this vehicle data is not associated with a particular individual .  However, if we do associate with a particular individual, then we will treat it as personal information in accordance with this Policy.  For more information on vehicle data, see our Terms of Use. 

Information Use and Sharing 

If you are a business user of a company that contracts with us, we will use your information to fulfill contractual duties with your company, which may include sharing your information with such company and other entities authorized by such company

We also generally use data from across our users to respond to you, regarding the reason you contacted us, to provide the Services, to improve the Services, to protect the Services and our systems, to enforce our terms, conditions and policies for business purposes, to comply with legal requirements, to respond to legal requests and to prevent harm.  

We may share your personal information with our service providers, including payment processors, cloud storage providers, analytics services, marketing partners, and IT or other technology service providers.  so they may provide services to us on our behalf.  We may share vehicle data and charging session data with our service providers, including our fleet management data and analytics providers, to provide services on our behalf and charging infrastructure developers so they can understand vehicle travel and charging infrastructure needs.  

We reserve the right to disclose and/or transfer personal information to a third party, if we have reason to believe that disclosing personal information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other website users, or anyone else who could be harmed by such activities.  Additionally, we may disclose personal information in response to a validly issued subpoena, warrant or other court order, or when we believe in good faith that a law, regulation, subpoena, warrant or other court order requires it—or authorizes us to do so—or to respond to an emergency situation.  

We reserve the right to disclose and/or transfer personal information to a third party in the event of a proposed or actual purchase, sale (including a liquidation, realization, foreclosure or repossession), lease, merger, or any other type of acquisition, disposal, transfer, conveyance or financing of all or any portion of Synop, Inc., or of any of the business of Synop, Inc., in order for you to continue to receive the same products and services from the third party; with our professional advisors, such as including accountants, lawyers and other professional advisers that assist us in carrying out our business activities and with your permission or otherwise in accordance with applicable law.  

Your Access To And Control Over Information

 Depending on your jurisdiction, we get permission before we set certain cookies and you can always prevent us from setting cookies that are not necessary for the performance of the Site. You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below.  You will then be removed from the marketing email list—however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.  

If you create an account to use Services, you may be able to update your information in the account as then permitted under current account settings. If you are a corporate user, we may refer you to your company for assistance if it controls your settings. 

Security

We use reasonable precautions, including technical, administrative, and physical procedures, to protect personal information from loss, misuse, or alteration. Although guaranteed security does not exist on the Internet or offline, we make commercially reasonable efforts to handle such information consistent with this Privacy Policy and applicable laws. Due to the design of the Internet and other factors outside our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third parties.  

Where Will We Transfer Your Information?

We are headquartered in the United States.  The Services are intended for individuals who are located in the United States  Canada, EEA, UK, or Switzerland.  If you are located outside of the United States, your personal information will be transferred and stored by us or our service providers in the United States.

Universal Opt-Out Mechanism 

Where available, you may choose to enable an online tool that automatically communicates your universal opt-out preferences, such as Global Privacy Control (“GPC”). You may need to use a specific browser or an extension that supports these tools and universal signals. 

Children’s Privacy

You have the right to object to the use of your personal information in certain circumstances.  For example (i) where you have grounds relating your particular situation and we use your personal information for our legitimate interests (or those of a third party); and (ii) if you object to the use of your personal information for direct marketing purposes.

We have internal procedures and policies regarding our handling of personal information to facilitate our compliance with this Policy and applicable laws, including with respect to retention of personal information, access to personal information by personnel, and the handling of complaints.
